Information Disclosed by User. Your use of the Site does not require you to disclose, nor require us to request or collect, any personally identifiable information ("PII"), including credit card or other financial information, (other than PII that you voluntarily disclose if and when you decide to make a donation to the Foundation online). Any collection, use and disclosure of such PII will be governed by our Privacy Policy. We do not request, solicit or intend to collect any such other PII and you should not disclose, enter or upload any such information on the Site. If we discover that such information was disclosed by you, we will exercise commercially reasonable efforts to delete such information; however, we are not liable for any consequences relating to such disclosures of information.
Links To Other Websites. Links to third party websites on this Site are provided solely as a convenience to you. If you use these links, you will leave this Site. Foundation has not reviewed these third party sites and does not control and is not responsible for any of these sites or their content. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk.
Links to Foundation Site. Anyone linking to any Foundation website, including this Site or content thereof, must comply with the Guidelines for linking to Foundation's website and all applicable state, federal, local and international laws. We regard the use of our registered and unregistered trademarks and service marks in metatags and/or hidden text as trademark infringement, and treat the use of these terms in page text, metatags, and/or hidden text for purposes of gaining higher rankings from search engines as unfair competition.
User Content. This Site is controlled by us from our offices within the United States of America. You may not use or export anything (including information) from the Site in violation of U.S. export laws, regulations or the Terms of Use. Your privacy is important to us. It is our policy to protect your Personal Information (as defined below) and to use it only in accordance with this Privacy Policy.
1. Acceptance of Privacy Policy. We want you, the User of our Site, to understand what data we collect from you when you visit our Site; how we use such data; and whether and to whom we share such data with others. Please read this Privacy Policy carefully. Using our Site is voluntary, and by accessing or using the Site, you: acknowledge that you have read and understood this Privacy Policy; agree that your access and use of the Site are subject to the Privacy Policy and Terms of Use; and consent to our collection and use of your Non-Personal and Personal Information as described in this Privacy Policy, as updated or revised from time to time. 3. Types of Information Collected. Several types of data are collected from you when you visit our Site, including: (1) Non-Personal Information; (2) Personal Information; and (3) Transaction Information. Certain types of data are specifically not collected, including any financial or credit card information (except to the extent included as Transaction Information), and personal information from children.
a. Non-Personal Information. We automatically collect information about your Internet connection, including but not limited to:
- The name of the Internet domain you used to access the Internet;
- The IP address of the web site from which you linked directly to our Site;
- The date and time you accessed our Site; and
- The pages you visited.
This information ("Non-Personal Information") does not identify you personally. We use this Non-Personal Information to monitor the effectiveness of the Site and to consider potential improvements to the Site. Information gathered may also be used in aggregate form for internal business purposes, such as generating statistics and developing marketing plans. We may share or transfer such aggregate, Non-Personal Information with or to our affiliates, licensees and partners. This data may be collected through cookies. b. Personally Identifiable Information. We only collect certain personally identifiable information about you via this Site when you provide it in connection with a request for information or when you elect to make an online donation ("Personal Information"). This information can be gathered when you send us feedback or an e-mail, when you register for certain services, when we set cookies, or directly in response to inquiries on the Site. In all such cases you choose whether to provide us with the personally identifiable information.
c. Transactional Information. We will collect the following Personal Information about you in connection with your request to make an on-line donation:
- name
- address
- phone number(s)
- email address
- donation amount
- credit card information: type of credit card, name on card, credit card number, validation number and its expiration date. ("Transactional Information").
Once the online donation is submitted in an encrypted format to our third party processing agent for payment processing we do not retain your credit card information on our Site. If you wish to make another donation in the future you will need to re-enter this information. In order to comply with reporting, tax and other applicable laws, we retain for archival purposes your name, contact information and donation amount. However, we maintain the privacy and security of this information as described in Section 9 below.
4. Use of Cookies in collecting Non-Personal Information. Cookies are small bits of data cached or stored on your computer based on Internet activity. We use cookies to monitor individual activity in aggregate to improve the Site. The information we gather may include IP address, user language, the operating system, browser type, the presence/absence of "flash" plug-ins, screen resolution, connection type, and information that identifies the cookie. However, no other user information is generally collected. We do not use cookies to obtain any personally identifiable information. Most web browsers automatically accept cookies, but you can usually change your browser settings to prevent this. If you disable cookies, you may be unable to use certain features of the Site.
5. Information NOT Collected.
a. Personally Identifiable Information. Except for the Transactional Information relating to on-line donations, our activities and your use of the Site do not require you to disclose, nor require us to request or collect, any financial or credit card information, or any other personally identifiable information not described above, such as home contact information, date of birth, Social Security number, or other similar non-public PII. We do not request, solicit or intend to collect any such information and you should not disclose, enter or upload any such information on the Site. If we discover that such information was disclosed by you, we will exercise commercially reasonable efforts to delete such information; however, we are not liable for any consequences relating to such disclosures of information.
b. No Personal Information from Children. We do not knowingly collect PII from children under the age of 13. Children are not permitted to use the Site and we request that children under the age of 13 not submit any personal information to the website. Since information regarding children under the age of 13 is not collected, the Foundation does not knowingly distribute PII regarding children under the age of 13. However, if the parent or guardian of a child under 13 believes that the child has provided us with PII, the parent or guardian of that child should contact us at www.rumsfeldfoundation.org to request that this information be deleted from our files.
6. Use and Disclosure of Information Collected. Our use and disclosure of certain information varies with respect to the type of information collected, including: (1) Non-Personal Information; (2) Personal Information; and (3) Transactional Information.
a. Non-Personal Information. We use the Non-Personal Information collected through the Site for statistical purposes and for improving the functionality of the Site. We may engage a third party's software or services to assist us with these analyses. In some cases, disclosure of this information to a third-party is necessary; however, the data remains anonymous at all times.
b. Personal Information. If applicable, we use the Transactional Information that includes certain Personal Information as described below. We also use PII collected through the Site for purposes of communicating with you and sending you, at your request, information including:
- free electronic newsletters; and
- promotional e-mails for activities related to our Site or organization.
You will have the choice to opt-in to receive newsletters and promotional e-mails for additional products and/or services. Also, we may use third-parties to assist us with our marketing efforts, but we do not provide PII collected through the Site to any third party for their own marketing purposes.
Disclosure of Personal Information to third parties for other, non-marketing purposes may occur in certain situations such as:
- Responding to a subpoena, court order or other such request;
- Responding to a law enforcement agency's request or as otherwise required by law; and
- Providing Personal Information to a third party if we file for bankruptcy, or there is a transfer of our assets.
c. Transactional Information. We use the Transactional Information (including the Personal Information included in the Transactional Information) collected through the Site to facilitate the making of donations to the Foundation and to comply with any reporting, tax or other applicable laws.
We do not provide Transactional Information to any third party for their own marketing purposes. Disclosure of Transactional Information to third parties for other, non-marketing purposes may occur in certain situations such as:
- Responding to a subpoena, court order or other such request;
- Responding to a law enforcement agency's request or as otherwise required by law; and
- Providing Personal Information to a third party if we file for bankruptcy, or there is a transfer of our assets.
7. Consent to Use of Personal Information. When you submit your Personal Information on this Site, you are giving your consent to the collection, use and disclosure of your Personal Information as set forth in this Privacy Policy. If you would prefer that we not collect any Personal Information from you, please do not provide us with any such information. By submitting your Personal Information, you agree that the Foundation may use such information to fulfill your request for information, to make a donation, or respond to an email or other request. You cannot opt-out of receiving communications from us (or third parties who may assist us) relating to an online donation. However, we do not share your credit card or other account information with unaffiliated third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities including, but not limited to, processing the donation.
8. Other Websites. We are not responsible for the privacy policies of websites to which the Site links. If you provide any information to such third parties, different rules regarding the collection and use of your personal information may apply. We strongly suggest you review such third party's privacy policies before providing any data to them. We are not responsible for the policies or practices of third parties. Please be aware that our sites may contain links to other sites on the Internet that are owned and operated by third parties. The information practices of those websites linked to our site is not covered by this Policy. These other sites may send their own cookies or clear GIFs ("Graphics Interchange Format") to users, collect data or solicit personally identifiable information. We cannot control this collection of information. You should contact these entities directly if you have any questions about their use of the information that they collect.
9. Security. We take appropriate steps to manage the privacy of your Personal Information and Transactional Information and the security of the Site. However, we cannot guarantee the security of any information that is disclosed online. We use the Secure Sockets Layer (SSL), a security protocol that protects your credit card information and ensures secure online donations. SSL Internet connections are encrypted, and thus protect all credit card information, including your name, address and credit card number, so it cannot be read in transit. We use secure technology, privacy protection controls, and restrictions on employee access, to safeguard your personal information. We do not retain the credit card information after the transaction is completed. However, we cannot guarantee the security of any information that is disclosed online.
